H1B Visa Program - Process and Requirements for the US H1B Work Visa

●     Finding support or sponsor

In getting an H1B visa, you need to have a sponsor. A sponsor is a US company or employer who will be willing to support you.

●     Prepare and file a petition at the proper USCIS office

The next step after surpassing the LCA is submitting the necessary forms such as form I-129, education and experience evaluation, training certificates, resume, employment agreement, and letter of support.

Then wait for it to be processed. Processing time may vary depending on the service center. Some may take a few months upon completion. If the H1B employer will eagerly show a desperate and abrupt need for the execution of the work to be done, then the USCIS may prioritize it and it will be able to be processed sooner.

Employment cannot begin until the USCIS finally issue an appropriate visa. But then again, there are those who won’t wait for the approval and immediately jumps into the opportunity of working abroad. This could be one of the mistakes and high risk is taken by some. Because of the fear of the time-consuming process of getting an H1B visa, they tend to go immediately to the US without considerations with such authorization and later being caught in so much despair by such actions and decisions.

But then, there are still those who were considered to be lucky enough to be able to get through it. But then, it is at your own risk.

●     Petition Approval

An approval notice or Form I-797 will be issued to the petitioner. It will contain the dates of validity for foreign workers to work in H1B status for the petitioner.

●     Valid Original Passport

You are required to firstly get a passport with the validity of at least six months beyond your interview date. All your previous passports if applicable will be necessary, too.

US Application Forms such as DS-160 confirmation page stamped at the Visa Application Center together with the application payment receipt and visa interview appointment letter, as well as the original notice of action I-797.

If married or in cases of dependents or children with age 21 years and below are intended to complete an H4 visa application which can be done at the same time as you file with H1B visa or after your visa approval with H1B.
